Terms of Trade
1. Pricing
1.1 Unless otherwise stated ALL Beamline Ltd Quotes excludes GST.
1.2 Quotes given, unless otherwise stated are for structural steel detailing ONLY and do not include site measures, stairs and handrails as well as miscellaneous steel (non-structural) items or variations.
1.3 All variations will be charged at NZD$100.00 per hour or by negotiation.
1.4 The price for the goods and/or services provided under this agreement shall be based on the pricing plans as stated in the initial quote provided. Any additional details, connections, modifications, or the inclusion of steel or materials not explicitly covered in the original pricing plans shall be considered as additional costs.
2. Payment
2.1 Payment must be made on the 20th of the following month of invoice’s issuing date, unless agreed upon in writing by the client.
2.2 Any expenses, costs or disbursements incurred by Beamline Ltd in recovering any outstanding monies including debt collection agency fees or solicitor's costs shall be paid by the Client.
2.3 Client must pay Beamline Ltd any fees or costs imposed on Beamline Ltd if any payment you make to Beamline Ltd is dishonoured or reversed.
2.4 Client must inform Beamline Ltd of a disputed invoice within 14 days of receiving invoice. Failure to notify Beamline Ltd, may result in a 10% penalty past the due date.
3. Delivery
3.1 At the time of acceptance of this tender start timeframes are subject to change depending on the current workload.
3.2 Beamline Ltd carry’s no responsibility for any errors if client fabricates from approval set of drawings.
3.3 Client must notify Beamline Ltd of any mistakes or corrections on Fabrication set of drawings prior to fabricating or during fabrication. Failure to do so within this time frame voids Beamline Ltd of responsibility.
3.4 Electronic CAD, DXF files & models can be provided upon request.
4. Maximum Back Charge
4.1 These specific percentages are intended to provide clarity and fairness in determining maximum back charge amounts for different types of projects undertaken by Beamline Ltd. It is essential for both parties to be aware of and agree to these terms at the outset of each project. Any deviations from these back charge percentages must be documented in writing and consented to by both parties.
4.1a New Builds: For projects categorized as "New Builds," the maximum back charge allowable shall not exceed 10% of Beamlines Ltd awarded job total, unless otherwise agreed upon in writing and confirmed by both parties.
4.1b Design Builds: For projects categorized as "Design Builds," the maximum back charge allowable shall not exceed 5% of Beamlines Ltd awarded job total, unless otherwise agreed upon in writing and confirmed by both parties.
4.1c Strengthening: For projects categorized as "Strengthening," the maximum back charge allowable shall not exceed 5% of Beamlines Ltd awarded job total, unless otherwise agreed upon in writing and confirmed by both parties.
5. Site Measures
5.1 Unless agreed to in writing, no site measures will be carried out and will be sole responsibility of client.
5.2 If site measures are carried out by Beamline Ltd these will be carried out at a charge out rate of $100 an hour, unless agreed upon in writing.
5.3 Unless agreed upon this price excludes incorporating site measures.
6. Exclusions
6.1 No allowance has been made for any structural steel NOT shown in the Structural Engineers drawings.
6.2 Only Timber fixings shown in the structural drawings at the time of this tender are included in this price. Any additional timber fixings will be considered a variation.
7. Intellectual Property
7.1 All 3D models made in the process of producing, approval and fabrication drawings will remain the property of Beamline Ltd, unless otherwise agreed upon in writing.
If we accept work from a client, a binding contract between you and Beamline Ltd will arise on these terms of trade. This Contract may be amended only by written agreement between you and Beamline Ltd. By using Beamline Ltd Steel Detailing Service, you agree to these Terms of Trade.
